2. Legal framework and scope
This Policy complies with Statutory Law 1581 of 2012, Decree 1377 of 2013 (compiled in Decree 1074 of 2015), the instructions of the Superintendence of Industry and Commerce (SIC) and other concordant regulations.
It applies to the personal data that Singularity Foundry processes, collected through the Site, forms, email, events, social networks, meetings or business relationships. It protects all data subjects, regardless of their nationality or place of residence. Numeral 15 adds guarantees for subjects located outside Colombia.
3. Definitions
- Authorization:
- prior, express and informed consent of the data subject to process their data.
- Privacy notice:
- communication that informs the data subject about the existence of this Policy, how to consult it and the purposes of the processing.
- Database:
- organized set of personal data subject to processing.
- Personal data:
- information linked or that can be associated with an identified or identifiable natural person.
- Sensitive data:
- data that affects the privacy of the data subject or whose improper use may generate discrimination, such as health, ethnic origin, political orientation or biometric data.
- Processor:
- person who processes data on behalf of the controller.
- Controller:
- person who decides on the database and the processing; in this Policy, Singularity Foundry.
- Data subject:
- natural person whose personal data is processed.
4. Processing purposes
Singularity Foundry processes personal data for the following purposes:
- Responding to information requests made through the Site, forms or email.
- Managing the commercial and contractual relationship with clients, suppliers and allies.
- Managing registrations for events and Singularity Foundry activities.
- Sending information about services and events, if the data subject authorizes it.
- Managing personnel selection and hiring processes.
- Maintaining Site security and preventing fraud or unauthorized access.

6. Data subject rights
As a personal data subject, you may exercise the following rights:
- Know, update and rectify your personal data.
- Request the deletion of your data when no longer necessary for the purpose that motivated its collection.
- Revoke the authorization granted for processing your data.
- Request proof of the authorization granted.
- Be informed about the use made of your personal data.
- File complaints before the Superintendence of Industry and Commerce.
7. Security measures
Singularity Foundry adopts technical, human and administrative measures to protect personal data against damage, alteration, loss, unauthorized access or misuse. Databases remain in force while the company develops its corporate purpose.
Singularity Foundry periodically reviews its databases. When data is no longer necessary for the purpose that justified its collection and there is no legal duty to retain it, it is deleted or anonymized.
8. International data transfers
Personal data may be processed by providers located in the United States, who operate under the EU-US Data Privacy Framework or the standard contractual clauses of the European Commission. Singularity Foundry does not sell personal data or share it for behavior-based advertising on other sites.
9. Data subject authorization
Singularity Foundry will obtain the data subject's prior, express and informed consent before processing their personal data, except where the law exempts it. Authorization may be granted in writing, electronically or by any means that allows subsequent consultation.
10. Channels to exercise rights and file complaints
Data subjects may exercise their rights or file complaints through the following channels:

Singularity Foundry will respond to requests within fifteen (15) business days, unless the law establishes a different term.
11. Processing of sensitive data
Singularity Foundry will not process sensitive data (health, ethnic origin, political orientation, biometric data, etc.) without the data subject's prior, express and informed consent, except in legally excepted cases.
12. Processing of minors' data
The Site is intended for persons over 18 years of age. Singularity Foundry does not intentionally collect personal data from minors. If it discovers that information has been collected from a minor without the consent of their parents or guardians, it will be deleted from the databases.
13. Personal data and terms of use
The processing of personal data is governed by this Policy and the Terms and Conditions of Use of the Website, which are integral parts of both documents.
14. Access from outside Colombia
Singularity Foundry operates from Colombia and is primarily aimed at the Colombian market. Singularity Foundry does not state that its contents are suitable or available in other countries.
Whoever accesses from abroad does so on their own initiative and is responsible for complying with applicable local laws. Singularity Foundry may limit access from certain jurisdictions. The rights of visitors from abroad regarding their data are explained in numeral 15 of this Policy.
European Union, European Economic Area, United Kingdom and Switzerland. If Regulation (EU) 2016/679 (GDPR) or an equivalent norm applies:
- Legal bases: we process your data to perform a contract or attend to prior steps you request; with your consent (newsletters and image use); on legitimate interest (Site security and professional relationship management), and to comply with legal obligations.
- Rights: access, rectification, erasure, restriction, portability, objection (including objection to marketing) and withdrawal of consent without affecting prior processing. Exercised at legal@singularityfoundry.tech and answered within a maximum of one month.
- Complaints: you may file them before the data protection authority of your country of residence.
- Data transfers: when you send us your data directly, it is processed in Colombia.
- EU representative: as of the date of this Policy, Singularity Foundry has not designated a representative in the European Union. It will designate one when Article 27 of the GDPR requires it.
United States. Residents of states with privacy laws, such as California, may exercise the rights recognized by those laws through the channels in numeral 10.
Other countries. Singularity Foundry will attend to the rights recognized by the law of the data subject's country of residence, to the extent applicable, through the same channels of this Policy.
15. Validity and changes
This Policy is effective since November 3, 2026. Substantial changes will be published on the Site and communicated to data subjects before being applied. If processing purposes change, Singularity Foundry will request new authorization.
