1. Who we are
The website singularityfoundry.tech (the "Site") is operated by Singularity Foundry S.A.S. ("Singularity Foundry"), a Colombian company identified with NIT 902108700-5, domiciled in Bogotá D.C., address Calle 144 No. 12-61, Casa 24, email legal@singularityfoundry.tech and telephone 300 123 4567.
2. Acceptance
Whoever accesses or uses the Site (the "User") accepts these Terms and Conditions (the "Terms") and the Personal Data Processing Policy. If you do not agree, you must refrain from using the Site. Acceptance by electronic means has full validity in accordance with Law 527 of 1999.
3. Purpose of the Site
The Site informs about Singularity Foundry, its company-building (venture building) and knowledge intermediation services, its RAD methodology, its SF Fabric platform, its events and its contact channels.
The content of the Site is informational. It does not constitute a binding commercial offer, professional advice or a promise of results. Any service is governed by the contract the parties sign.
4. Users
The Site is intended for persons over 18 years of age and organizations. Whoever uses the Site on behalf of an organization declares having the authority to represent it.
5. Permitted use and prohibited conduct
The User is obliged to use the Site in accordance with the law, good faith and these Terms. Prohibited:
- Accessing without authorization to systems or restricted areas, or breaching security measures.
- Introducing viruses, malicious code or loads that affect the functioning of the Site.
- Extracting content in a massive or automated manner (bots, crawlers, scraping) without written authorization, except search engines within what the
robots.txtfile allows. - Using Site content to train, adjust or evaluate artificial intelligence models without written authorization.
- Impersonating identities or sending false information.
- Using the Site to send unsolicited advertising or for illicit purposes.
Some of these conducts may constitute crimes under Law 1273 of 2009. Singularity Foundry may block access to those who commit them and exercise the corresponding legal actions.
6. Intellectual property
The Site's contents (texts, designs, logos, graphics, software, described methodologies and databases) belong to Singularity Foundry or its licensors. They are protected by Law 23 of 1982 and Andean Decisions 351 of 1993 and 486 of 2000.
The names Singularity Foundry, SF Fabric and RAD, and the other distinctive signs of the Site, may only be used with prior written authorization. The User may consult the Site and share its links, but may not reproduce, modify, distribute or commercially exploit its contents without authorization.
7. Information submitted by the User
The User guarantees that the information submitted through forms, email or registrations is truthful and that they have the right to share it, including that of third parties.
Ideas, projects, business plans or proposals that the User submits through the Site are not considered confidential information nor create a contractual, association or exclusivity relationship, unless the parties have previously signed a non-disclosure agreement. The submission does not prevent Singularity Foundry from evaluating or independently developing similar projects. Therefore, we recommend not sending confidential or strategic information through Site forms.
8. Events and registrations
Registrations for Singularity Foundry events are governed by the terms of each call. Events may be photographed, recorded or broadcast; the use of attendees' image is informed at registration and processed in accordance with the Personal Data Processing Policy. Singularity Foundry may modify or cancel an event and will communicate it to the contact details provided.
9. Site availability
Singularity Foundry endeavors to keep the Site available and secure, but does not guarantee that it will function without interruptions or errors. It may modify, suspend or withdraw the Site or its contents at any time.
10. Links and third-party services
The Site may contain links to third-party sites or services. Singularity Foundry does not control or respond for their contents, conditions or privacy practices.
11. Liability
To the maximum extent permitted by Colombian law, Singularity Foundry is not responsible for:
- Decisions made by the User based on the Site's informational content.
- Damages caused by viruses, attacks or technical failures beyond its reasonable control.
- Site interruptions or loss of information sent through it.
- Contents or services of linked third parties.
This limitation does not apply in cases of intent or gross negligence by Singularity Foundry, nor does it restrict the inalienable rights that the law recognizes to consumers and data subjects.
12. Indemnity
The User shall keep Singularity Foundry harmless against third-party claims caused by their breach of these Terms or by illicit use of the Site.
13. Personal data
The processing of personal data is governed by the Personal Data Processing Policy and the Cookie Policy, which form part of these Terms.
14. Access from outside Colombia
The Site operates from Colombia and is primarily aimed at the Colombian market. Singularity Foundry does not state that its contents are suitable or available in other countries.
Whoever accesses from abroad does so on their own initiative and is responsible for complying with applicable local laws. Singularity Foundry may limit access from certain jurisdictions. The rights of visitors from abroad regarding their data are explained in numeral 15 of the Personal Data Processing Policy.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Colombia. In the event of any controversy, the parties will attempt a direct settlement for 30 calendar days; if they do not achieve it, they will submit it to the courts of Bogotá D.C.
The foregoing is without prejudice to mandatory consumer protection or data protection laws that the User may invoke according to their place of residence.
16. Modifications
Singularity Foundry may modify these Terms. The current version is the one published on the Site with its date, and important changes will be announced on it. Continuing to use the Site after publication implies acceptance of the new version.
17. General provisions
If any clause is declared invalid, the others remain in force. That Singularity Foundry does not demand a right does not imply waiver of it. If there is a translation of these Terms, the Spanish version prevails.
